Isn't that a US Federal Law, so it wouldn't apply oversees, and anytime you mod a car it would affect warranty coverage.
In the US, the dealer and manufacturer have to prove that the modification caused the issue. For example, having a JB4 tune did not cause three sets of HPFPs to fail on our N54 and the dealer gave us no trouble.

It can be stricter in other countries, Germany is really tight, but an aftermarket tune does not equal 'no warranty.'
The dealer could have given you trouble and voided the whole power train warranty as some dealers are not so mod friendly. They chose not to in your case. The HPFP would have to have failed without the jb4. This is a known issue with the N54 so they went ahead and did it for you. Even a BMS intake could prevent passing emissions test though it may not affect tail pipe emissions as they simple refuse to do the test if they see one and fail you on the spot.
