Have you gotten any OTA updates? Assuming not, then I think the easy argument would be that you have "Remote Software Upgrade" included until xx/xxxx on your connected drive account, but you haven't been getting any updates, so you are requesting them to update it at the dealership, as there must be something technically wrong.
If you have been getting OTA updates, then I would side with them, and you'd have to wait until the 7/2020 updates start rolling out remotely (should start in November), or pay to play.
