That sounds like a legit issue. Do you use the paddles a lot? Also, was it stuck in the pulled-towards-you position (clicking to make the gear shift position, if you know what I mean)?
And you should ask them for a better car Our dealer here always gives us a car that is one better than what you have (when we went with the X3 for service, our loaner cars were a 440i, 535i, X5 and 530i).
