Oh lord.
If it puts out more than its stock rating, that's not false advertising brah... and it's not like the power isn't there ? A tune can unlock it.
ps. Would it be wrong for the OEM to offer multiple levels of tune .... ? And charge you for that higher state of tune ... ? A " competition package does just such a thing but a tune could be a standalone item.

BMW isn't gonna max out their engine design BECAUSE they warranty your car for YEARS OF USE.
A tuner can max your car out and has no responsibility to replace your drivetrain.
