Isn't that a US Federal Law, so it wouldn't apply oversees, and anytime you mod a car it would affect warranty coverage.
In the US, the dealer and manufacturer have to prove that the modification caused the issue. For example, having a JB4 tune did not cause three sets of HPFPs to fail on our N54 and the dealer gave us no trouble.

It can be stricter in other countries, Germany is really tight, but an aftermarket tune does not equal 'no warranty.'
The dealer could have given you trouble and voided the whole power train warranty as some dealers are not so mod friendly. They chose not to in your case. The HPFP would have to have failed without the jb4. This is a known issue with the N54 so they went ahead and did it for you. Even a BMS intake could prevent passing emissions test though it may not affect tail pipe emissions as they simple refuse to do the test if they see one and fail you on the spot.
They can deny it, but the consumer can escalate it, either to the regional office, country or manufacturer. The whole knee jerk reaction people have of 'tunes void you warranty' simply isn't true, it would only apply to the powertrain at worst and would have to be a verifiable issue to actually be credibly denied.

I've had a number of mildly modified cars and just about every area modified has had dealer warranty coverage and I've never had any trouble with it. I'm not advocating every one running out and getting a tune, but it's not the peril some folks make it out to be.
Taking a 330e to over 400 horsepower is not a mild modification and could stress the 4 cylinder beyond design limits. While a JB4 might be overlooked this would be less likely to be overlooked when making a warranty claim related to the power train.
The electric motor is rated at 112hp. Is not that outrageous to get the 4cyl to 290hp or what am I missing?
It is tuned to 184 HP stock, though it probably has similar internals to the gas only version. It could make for a nice sleeper or you can pimp it out and make it look like an M340. Doesn't look like we have this in the states yet, or when it is coming, but they are not that popular here as 3 series is not really viewed as an economy car here so we don't get the 3 cylinder version or even the 320 with a manual.
