Dealership damaged my car!
Hey guys I'm seething right now. I had an issue where my p button malfunctioned so it would not get out of P once starting. I got the car towed to the dealership parking lot last night.
Today, the dealership let me know they had to move the car on a tow truck to their work area. And the dolly damaged my rear side skirt. This looks bad from my eyes it looks like there are scratches above the side skirt on to the door panel? What is the fix here? Replace and paint the side skirt? They are willing to cover the cost. But if I'm painting the door panel and stuff the value of my car is shot Do I have options of suing them? |

An unfortunate accident. Have them replace the side skirt. The value of your vehicle won’t be affected from something as minor as that.

Have them fix it, it’s minor damage and won’t affect the value of the car. And the dealership will replace original parts , they will not upgrade you to M sport side skirts just because they accidentally caused damage to your vehicle. It was unintentional damage not malicious damage.
Unless you can provide evidence that it was intentional. Just have them do a good job. ( unless you yourself upgraded to msport side skirts , then they would have to replace it with m sport side skirts to match the opposite side. Other wise your stuck with oem but not an oem upgrade) Keep these pictures on file for when you sell the car and they pull up the repair on carfax this way you can show that it was minor damage. Carfax doesn’t provide specifics on how much damage was caused. |

Had a similar issue with one of my past bimmers, a 650i. Had at the dealership for some repairs and they dented rear quarter panel. When I went to pickup the car and noticed the dent I refused to take it, kept the loaner they gave me and they fixed it up perfect for me. Did not effect my value or put any hits on my carfax fortunately

What precisely would be the basis for suing them? Seems like there was an accident, they fessed up to it without you having to prompt them, and are now fixing it. Judging by the location, you may not have even noticed it until well after picking up the vehicle by which time it would have been to late to pin it in the dealership. I’d say they’ve shown as much integrity as can be reasonably expected. There are plenty of company’s that deserve a good suing. This is not one of them.
The main thing you want to discuss with them is keeping if off the CARFAX or providing with diminished value compensation if it does end up on the CARFAX. If they go through their commercial insurance or the shop’s DMS software reports to CARFAX, it’s inevitable but they should compensate you for that.
