Delivery Nightmare
I want to thank everyone in the community for posting. I was grateful to go in to the dealer with knowledge about price protection and the 1.9% financing.
I was a June 1 2021 reservation holder, so got one of the first west coast m50 allocations. It arrived at the dealer and I was ecstatic. The first salesperson I talked to knew all about the price protection and promotional financing, but then tried to get me to sign a sales agreement with neither applied and an extra markup on top. All told it was $9k more. This after already being upset about losing the $7500 tax credit really pissed me off. I told them to fix the sales contract before I signed it, then they started telling me they “couldn’t hold the vehicle” for me. When I called back they told me “it sounds like this isn’t going to work out” and said they were refunding my deposit and had listed my car for sale. I immediately told them (in writing) that I had not released interest in the vehicle and intended to purchase it. Then relations went downhill. It’s really unfortunate that they think they can just steal the car from me and resell it. |

That's really ridiculous. They can't raise the price at delivery. Your deposit and build sheet should be enough to win that battle with BMW na. Really curious who the dealer is bc that's shady and you would want people to be aware

I don't recall BMWNA ever intervening on the price paid by a person when in dispute with a dealer. Which is why I don't think this will work now.

Unfortunately dealers have become even more shady in this market and my guess is bmwna won't do squat. Sorry to hear this happened to you. You should out the dealership

Actually ordered on west Coast also would like to know which dealer. If it's the same dealer I would pick another one.

I also doubt BMWNA will intervene. Any "price protection" from BMWNA is only protecting the MSRP. It's not protecting against any additional dealer markups whether through some bogus add-on the dealer makes you buy to jack up the price, or just outright throwing "fees" on with no tangible value.
I have observed a pattern in this behavior... almost every time someone complains of this happening I have noticed the location of the dealership rhymes with Kalifornia. |

The dealers don't have an obligation to deliver the vehicle without markups unless their agreement with BMWNA requires them to do so.
Your agreement with BMWNA cannot be enforced against the dealer unless they are a party to that agreement. That being said, seems very shady but in line with CA markups here which are insane for all cars right now. |

The name of that dealer and salesperson should be all over the forums at this point.
I would park a car in front of the dealer indicating how they treat customers. For the record I did that once. I parked a car outside the dealership on public property with signs in the window saying their service department attempted bait and switch. My car sat there for about an hour. They sent someone out to negotiate me leaving. There is no way I'd let this ride. Walking the sidewalk with a sign saying they tried to rip you off with a copy of your original stuff and the new stuff they put in front of you. I'd give them all the grief possible as a matter of principle.

100% BMWNA and Porsche NA told me point blank that it is msrp (focus on the word suggested) and any dealer can ask what ever they want for a vehicle and the manufacturer and Corporate will not and cannot intervene.

Unless BMWNA says that their preorder terms can be changed by the assigned dealer at any time -it would not be a preorder then- then there is nothing that any customer can do to enforce the preorder premise.
Only BMWNA can say whether all preorder customers can be screwed at time of delivery by the assigned dealer, or they are not allowed to change the preorder terms. Anything else is fighting blind. |

Hey - I am in the west coast too and just picked up my i4 M50 from the dealer yesterday. The dealer stuck with the original quoted MSRP throughout the process and never added any dealer markup. Pretty happy with the buying process. I also got 2.9% financing after negotiating a bit.

So an update. My sister went to the dealer to do some reconnaissance. She inquired about the cars and chatted up a sales guy. Eventually he told her that ALL FIVE of the preorders had cancelled and were up for sale.
I started reaching out to some other dealers to see how allocations were coming in the event I had to bail out. Finally I went back in and lo and behold, they were super friendly and ready to go on the financing AND price protection. My theory is that they overestimated the market - at a time when everyone wants SUVs, and are afraid of rising interest rates, the only people in a small town who want to buy an i4 and haven’t already bought a Tesla are the ones holding the pre-orders, and if you piss them off you shoot yourself in the foot. |
