It's the same rules as the wheels/tires that come on the car. So you have to keep the wheels reasonably nice and return the tires above a certain wear indicator.

BMW issued a technical bulletin that the MPE has been discontinued on the M340 and M440s, till further notice. Cars with MPE on the build sheet had it dropped off and it's also been taken off the port install option tool. These are due to supply shortages. Word is that it will take some time, no line of sight yet from AG on supply replenishment. |

Edit: For those of you who know for a fact that you got screwed out of the MPE and are still looking for a replacement for stock, there is the Dinan unit that is currently on backorder - reached out to my contact and was told inventory should be replenished by April/May.
