Exclamation Rear Tailgate Opens by itself 330e

I took delivery of a new 330e touring, all good at first then after last Sunday the rear tailgate opened by itself, the car is only one week old. I closed it but within 5 minutes it was opened again. This happened at least 6 times so i had the car recovered. Dealer has said they cannot find anything wrong with the car. I did not have the keys in my pocket they were in another room on the table.

I have read lots about signals jamming keys but this wasn't that, in fact the tailgate opened as the recovery driver was driving it onto the truck. As I am new to BMW i am hoping someone on here may have a suggestion about what might be going on.

No I don't have comfort access, also after the first couple of times there was nobody near the car. I moved it onto my drive and sat in it with it unlocked waiting for the recovery truck it opened then as well. It also opened when the driver was driving it on to the truck, i was stood at the side of the car with a clear view all around it.

That was my first thought when it happened but it wasn't that the 2nd key was not touching anything. I think the 5 minute interval is somehow connected, as if its getting to a point in the close down program then faulting.

Perhaps the 'wave your foot underneath' sensor isn't working. (Or does that use the parking sensors?)

I’ve had the boot open and windows opened because of the fob being activated in my Jeans pocket. I’ll never carry the fob in a tight pocket again.

why not try removing the batteries from each key - and monitoring for a while to see if the issue still occurs - at least this will prove if it is the key or something else causing the issue.

You could also wrap the keys in tin-foil I guess would do the same.

I will try that if I have to take the car back. it has been with the dealer for 10 days and they cannot replicate the same error. I have started the process of rejecting the car as its only a week old.
