To be clear - I would have been okay with this lightly modified car, IF I HAD KNOWN. In the future I wanted to do these exact mods, after the warranty was up. I want to keep her, but after this frustration I am thinking about it.

I assume the car was purchased out of state?
Thus finding now it won’t legally pass TX emission test? Yea Audi should never have sold the car like that if there is in-state emission/inspection testing. Car should have had “off-road use only” tagged to it. OP was misled on the car’s condition and should lawyer up immediately, if it were me and no other options I would dump the car (CarMax?) and take it unfortunately as a hard lesson learned. I’d be way too worried of worse and more expensive problems coming down the road to keep it. |

I have the car back on the road, and a lengthy email with my attorney cc'd to their Sales mngt team to recoup current and furure repairs that are relevant.
- the DME has been restored to stock -a downpipe mod was discovered, and codes thrown for O2 sensors still exist. These codes were being muted by the tune, so no check engine light. -The subs under the seats blew! Music sounds awful now. Codes for subs and radio/battery persist. I've asked Audi dealership where I bought it to reimburse me to basically make the car right again, and pass future inspection, or allow me to return for full refund. We'll see what they say. |

Just curious, could a piggyback mod suppress O2 sensor codes as well? I reached out to femto and several popular tuning platforms, who all said no except 1 which said we can't tell you.

If you want to return the car, and based on the VIN being flagged you might, get a lawyer.
You should be able to argue that the car was sold with a 2 year warranty and they are refusing to honor it. The dealer should be considered an "expert" and they should not be able to deny the warranty after the fact if they missed something. You as the consumer rely on the expert to make sure the car meets their requirements for the warranty. |

Audi dealer responded: I can return car for a full refund, however they are not able to help with any of the repair costs. Decisions... I think I will have the car looked at closely, especially the downpipe/O2 situation, and decide. Finding an xdrive in TX with Shadowline, black with red interior, and my pricerange, i think I will keep it. What would you do?

I would return it and wait for a better example.
I expanded my search distance and ended up traveling from Dallas to Houston to pick up my 24' M340. It took me 6 months until I found the right color and specs. 6 weeks of that waiting was for a Black M791 rims (vs 792M & Portimao Blue on the car I bought) that was going to be delivered to the Dallas dealer but just sat built at the Mexico port. I guess there was a large delay with shipping transport or something in Oct/Nov 2023. |

Send that car back. There are tons of them on the market. It's not a Bugatti. It's a M340. Also, a modded car is probably run harder than a stock car so longevity could be at play here. |

That would likely make it not cost effective. As far as finding the car you want, find a reputable BMW dealer and have them do a search and keep an eye out for the car you want. It is a pretty common situation for them. |

Surely it would have fallen under false advertisement and, being from a dealership, wouldn’t have fallen in the ‘buyer beware’ category.

You're right. Why am I even thinking about it. Well honestly I really like the way the car drove when it was tuned and I didn't know it. Then I messed it all up with an update. Learned some hard lessons in the last 2 weeks. I'm (hopefully)1 tune and 2 underseat subs away from my perfect BMW. If I return it, then I will have to start over, go back to a rental car, buy again, and reinstall springs, dp, and figure out a tune basically just the same as I have to now. The real "cluster*" here was the process of being told your car is stock, when it wasn't... And making it right again. So yeah, depending on my PPI tomorrow with my trusted local mechanic, I may or may not send it back.
