MST intake cone filter touches the chassis (G20 330i)

I just installed my MST intake for the B46TU G20 330i and it seems that the fitment is quite tight, with the cone actually touching the chassis (touches the plastic "wheel well" thing). Is this normal? Am I contributing to structural degradation of the chassis or the cone filter by letting it be this way? I've tried to fit it in multiple different ways to avoid this but none of them have ended up working (and small bits of rubber on the end of the cone filter have been ripped up/off). I doubt those small rubber pieces will have any effect on performance but could airflow potentially be stifled because a part of the cone filter is touching a solid surface?
