M-Sport seat fitment - G21 M340d nightmare

To cut a very long story short (tried to keep this post short), I ordered an M340d with M-Sport seats (along with the comfort pack plus some other extras) in October 2023. I took delivery of the car in May 2024. (M340D touring LCI).

The car was sourced via a 3rd party leasing company (who I have used for 2 other cars previously), financed through a sister company and BMW Syntner supplied the vehicle.

When I took delivery, the M-SPORT seats were not included, I complained on delivery and I have had (in writing) from Syntner apologising that they made a mistake and did not specify the seats on the factory order. The rub here is that the person who wrote to me has left and bizarrely is now working for the leasing company

I have been chasing both the lease company and BMW Sytner for over 2 months and I am being passed from pillar to post with excuses and ghosting galore (IE weeks go by without any update)

The latest from BMW says "it's not technically possible" to retrofit M-SPORT seats to the G21 - I think this is bullsh*t and they don't want to swallow the cost (which I imagine is quite a bit).

The vehicle provider is part of https://www.bvrla.co.uk/ which would be the escalation stage.

Ideally, I want the seats supplied and fitted as I paid £980 for them, alternatively, I want the £980 credited to my finance agreement.

Has anyone else had similar and would any of you know more on my rights as a consumer? Or if the seats can be retrofitted?

That's a terrible story. I can't help with your predicament. For anyone reading this and for future reference, you get 30 days in which to reject a brand new car under the Consumer Rights Act. That's the ultimate sanction and they get a lot more willing to help once the rejection process is initiated.

Complain to BMW and mention how it’s spoiling the whole experience, and your confidence in the brand. I’ve found that as soon as you complain to the Manufacturer the dealers start behaving. Had it with Mercedes, Ford and BMW.

+1 above........ they are always going to try and fob you off to avoid paying for their mistake. I'd be going straight to BMW UK as above, and copy the complaint to both parties. Ultimately it is not as ordered and Sytner has admitted that so they need to make good. That may be a little complicated for them to work out as they probably gave the lease company a discount on the car incl the price of the options BUT its their problem. The seats can surely be fitted assuming that the type of sports seats (i.e. electrical adjustment etc) is the same as the ones you have otherwise the wiring may be different. You can always take them to small claims court as they dont have a leg to stand on. Go get them!

Small claims court is a good shout. You need to have taken all reasonable steps to reach a solution with the company before going to SCC. So stay polite, positive but resolute in all communications and keep copies.

I don't know if there is much difference but i have read comments that there is a difference in comfort between the standard and M-Sports seats.
If you write to BMW make it clear that you ordered those seats having previously experienced back pain with the standard seats.

I bought my M340i used, so didn't spec the car myself, but having test driven cars with the standard seats and the M-Sport seats, I am glad I have the M-Sport ones, I do find them considerably more confortable.

OP, I really hope you can get BMW UK to sort this out for you, dealers will try and get away with anything, until BMW UK step in.

I've got standard seats (as also a used buyer). They're not the most comfy seats in the world. I sometimes do 500+ milers and the seats in the e61 535d left you feeling fresh as a daisy. The one in the g21 give you a sore bum after a few hours. But nothing compared to some cars and I find them perfectly acceptable...but just know that there are more comfy ones.

If you have it in writing that you requested and specced those then you would have been within your rights to reject the car, at that point the dealer would probably suggest compensation or retrofitting them. Not sure where you stand if you have 'accepted' the car as is now but worth a try with BMW

After a LOT of effort, persistence, legal advice and letters to BMW and the dealer, the car has been rejected as the M-Sport seats cannot be retrofitted.

The dealer will buy it back and it's going to be replaced with a like-for-like late 2024/25 model at zero inconvenience/cost to me. I'll be keeping the current car until delivery of the replacement.

The only downside is no more diesel 😕, which I specifically wanted due to towing duties during the summer.

Overall - I think this is the best outcome.

Glad you reached an acceptable outcome. Rejecting the car is the only way sometimes.

I've had my share of "d" cars but getting the petrol is not a negative. M340i right? The B58 is a joy. Enjoy every moment whilst you can.

My new G21 LCI2 M340i has been picked up! I am very,very happy with the replacement!!

The dealer was exemplary in execution and delivery/handover

Faith restored 👍🏻👏🏻

PS Petrol motor is 😍
